    The regulations of the Bangaldesh Bank apply to directors holding equity in the banks. In pactise persons holding positions on the basis of the offcie are usaully excluded from the requirement.
    The Managing Director of a bank is proposed by the Board, not the Chairman. The current MD of the Trust Bank was appointed well before the Army Chief was the Chairman. Moreover under the regulations, the Bangladesh is really the authority that approves the appointment of a MD of a Bank.
    Furthermore the structure of the Trust Bank is totally different from other commercial banks and since the Memorandum and Articles of Association are approved by the central bank, this bank has the induldence to undertake things differently from other private sector banks, as such the misunderstanding.
